Important Notice

IRONMAN Flex Up ("Flex Up") is not insurance. Flex Up is a voluntary, contractual cancellation service that allows eligible Buyers to cancel their Event registration and receive a Partial Refund Amount, subject strictly to these Terms and Conditions ("Terms").

To receive the Partial Refund Amount, you must submit a cancellation request through the official Partial Refund Request Portal at ironmanflexup.com no later than 11:59 PM (local time at the Event location) seven (7) calendar days before the scheduled Event date. Cancellation requests must be timely submitted and approved in accordance with these Terms. Failure to attend the Event does not constitute cancellation.

If you transfer or defer your Event registration, or receive any refund, under the Event Organizer's standard Athlete Withdrawal Policy, Flex Up automatically terminates and the Buyer will not be entitled to any Partial Refund Amount.

The Event Organizer may use third-party service providers to administer Flex Up, including EmbedCover, which hosts and operates the Partial Refund Request Portal and may process refunds on behalf of the Event Organizer.

By purchasing Flex Up, you agree to be bound by these Terms.


Article 1 Certain Definitions #

For purposes of these Terms:

"Buyer"
means the individual who purchases Flex Up.
"EmbedCover"
means the third-party service provider engaged by the Event Organizer to host the Partial Refund Request Portal and administer certain aspects of Flex Up, including cancellation/refund request processing, compliance checks, and payment administration.
"Event"
means the specific IRONMAN® race, IRONMAN 70.3® race, or other race for which you registered and purchased Flex Up, as identified in your registration confirmation.
"Event Organizer"
means the applicable IRONMAN Group Member that owns, operates, licenses, promotes, or administers the Event and offers Flex Up at the time of purchase.
"Flex Up Fee"
means the fee paid to purchase Flex Up, as separately disclosed at checkout.
"General Entry Fee"
means the athlete general entry fee for the Event, including applicable taxes and third-party payment processing or platform fees. The General Entry Fee does not include the Flex Up Fee or any merchandise, add-ons (including any national triathlon federation license or membership fees), upgrades, hospitality packages, accommodation packages, bike transport, training programs, donations, transfer fees, deferral fees, installment fees, deposits applied to non-registration items, or any other optional goods or services.
"Ironman Affiliate"
means any entity that is owned and/or controlled by World Triathlon Corporation, where "control" includes direct, indirect, or joint ownership and/or control.
"IRONMAN Group Member"
means World Triathlon Corporation, any Ironman Affiliate, and any Ironman Licensee.
"Ironman Licensee"
means a third-party owner and operator of an Event that is owned and operated under a license agreement with World Triathlon Corporation or an Ironman Affiliate.
"Local Consumer Law"
means any consumer protection law applicable to the purchase of an Event entry. Depending on where you reside and/or where the Event takes place, this may include (by way of example only) the following consumer protection laws:
  • for an Event in Australia, the Australian Consumer Law
  • for an Event in New Zealand, the Consumer Guarantees Act
  • for an Event in Malaysia, the Consumer Protection Act
  • for an Event in a member state of the European Union or the European Economic Area, applicable EU-level consumer protection rules and the consumer protection laws of the relevant country.
  • for an Event in Switzerland, the Swiss regulations and ordinances on consumer protection.
  • for an Event in the UK, applicable UK consumer protection laws (including the Consumer Rights Act 2015, the Consumer Protection Act 1987, and related regulations and guidance).
"Partial Refund Amount"
means seventy-five percent (75%) of the General Entry Fee.
"Partial Refund Request Portal"
means ironmanflexup.com (or successor URL).
"Participant Agreement Framework"
means the Terms and Conditions of Entry & Participation (including any Release and Indemnity, Anti-Doping Rules and, where relevant, Arbitration Agreement)
"World Triathlon Corporation"
means World Triathlon Corporation d/b/a The IRONMAN Group.
Article 2 What Flex Up Provides #
2.1 Cancellation by Athlete for Any Reason

If you purchase Flex Up and submit a valid cancellation request in accordance with Section 4, you may cancel your Event registration for any reason whatsoever and receive the Partial Refund Amount, subject to these Terms.

You may cancel for any reason, including but not limited to:

  • Change of plans or schedule conflicts
  • Injury or illness (whether or not confirmed by a physician)
  • Travel complications
  • Work or family obligations
  • Financial reasons
  • Simply changing your mind

No documentation is required.

2.2 What You Do NOT Receive Back

The following amounts are non-refundable (except where required by applicable law or as expressly provided for under the Athlete Withdrawal Policy or Section 6.1 (but only if the Event is cancelled more than seven (7) calendar days before the scheduled Event date)):

  • The Flex Up Fee
  • Twenty-five percent (25%) of the General Entry Fee
  • Merchandise, add-ons, upgrades, travel packages, donations, installment fees, and other non-registration items

Article 3 Purchasing Flex Up #

Flex Up must be purchased at the time of initial Event registration.

Flex Up:

By selecting Flex Up and completing purchase, you acknowledge acceptance of these Terms.

Article 4 Eligibility Requirements and Cancellation Process #
4.1 Deadline to Cancel

You must submit your cancellation request no later than 11:59 PM (local time at the Event location) on the date that is seven (7) calendar days before the scheduled Event date.

This deadline is strict. If you miss the deadline for any reason, no Partial Refund Amount (or any other amount) will be payable under these Terms. Not attending the Event or failing to show up does not constitute cancellation.

4.2 How to Submit

To request your Partial Refund Amount:

  • Visit the Partial Refund Request Portal (ironmanflexup.com).
  • Enter the email address used for registration and complete any required authentication steps.
  • Submit the cancellation request through the Partial Refund Request Portal.

An automated confirmation email acknowledges submission only and does not constitute approval.

4.3 Timely Submission Requirement

Payment of the Partial Refund Amount is contingent upon timely submission in accordance with these Terms.

Article 5 Refund Processing and Timing #

Approved refunds will be initiated within twenty-four (24) hours after approval.

When submitting a Partial Refund Request, you will be asked to provide additional information to authenticate your request and to process payment, including the registrant's date of birth, city of birth, and country of birth, as well as the Buyer's address and banking details.

Funds are typically received within three (3) business days after initiation but may vary due to banking systems, payment processors, and card networks.

Partial Refund Amounts will be issued by EmbedCover, which will appear on the Buyer's bank statement as "IRONMAN Flex Up Refund," "IM Flex Up," or a similar variation.

The Event Organizer is not responsible for delays caused by third-party financial institutions, payment processors, card networks, or banking systems.

Article 6 When Flex Up Does Not Apply #
6.1 Event Cancellation by the Event Organizer

Flex Up does not apply if the Event is cancelled in its entirety by the Event Organizer.

If the Event Organizer cancels the Event:

  • The Event Organizer's standard Event cancellation and refund policies shall apply;
  • You must refer to the Participant Agreement Framework and any Event-specific policies, and any applicable Local Consumer Laws, for your rights and remedies;
  • The Partial Refund Amount under Flex Up will not be paid; and
  • You may be entitled to other remedies under Local Consumer Laws or as determined by the Event Organizer in accordance with applicable policies, which may include credit toward a future Event, a full or partial refund, or other options. If the Event is cancelled in its entirety by the Event Organizer more than seven (7) calendar days before the scheduled Event date, the Flex Up Fee will be refunded to the original payment method used at checkout. If the Event is cancelled in its entirety by the Event Organizer within seven (7) calendar days of the scheduled Event date, the Flex Up Fee will not be refunded, except where required by applicable law.

Important: Flex Up applies only to your voluntary decision to cancel your registration in accordance with Section 4. Flex Up does not apply to cancellation of the Event.

6.2 Event Postponement or Rescheduling

If the Event is postponed or rescheduled by the Event Organizer, the following provisions apply:

(a) You Accept the New Event Date (Rescheduled Within 12 Months)

If the Event is rescheduled to a date occurring within twelve (12) months of the original scheduled Event date and you elect to participate in the rescheduled Event:

  • Your Event registration (including your Flex Up purchase) will automatically transfer to the rescheduled Event date; and
  • You may still cancel under Flex Up, provided you submit your cancellation request in accordance with Section 4 and no later than 11:59 PM (local time at the Event location) on the date that is seven (7) calendar days before the rescheduled Event date.
(b) You Do Not Participate in the Rescheduled Event (Rescheduled Within 12 Months)

If the Event is rescheduled to a date occurring within twelve (12) months of the original scheduled Event date, and you decide not to participate in the rescheduled Event, your rights and remedies (if any) relating to the rescheduling of the Event are governed by the Participant Agreement Framework, the Event Organizer's applicable postponement/rescheduling policies, and any applicable Local Consumer Law. Flex Up does not limit or replace any such rights or remedies. Separately, and only to the extent you wish to use Flex Up as a voluntary cancellation option, you may request the Partial Refund Amount under these Terms if you submit a cancellation request in accordance with Section 4 based on the rescheduled Event date.

  • You may submit a cancellation request in accordance with Section 4;
  • You must submit your request no later than 11:59 PM (local time at the Event location) on the date that is seven (7) calendar days before the rescheduled Event date; and
  • You must not have participated in the rescheduled Event.

If you timely submit a cancellation request in accordance with Section 4 (measured against the rescheduled Event date) and you do not participate in the rescheduled Event, the Partial Refund Amount will be payable in accordance with these Terms. For clarity, Flex Up does not determine whether you are entitled to any refund, credit, deferral, or other remedy from the Event Organizer arising from the rescheduling itself, which is governed by the Participant Agreement Framework, Event-specific policies, and applicable Local Consumer Law.

(c) Event Postponed More Than 12 Months

If the Event is postponed to a date more than twelve (12) months after the original scheduled Event date:

  • The Event Organizer's standard postponement and Event policies shall apply; and
  • You must contact the Event Organizer's customer service to determine what options, if any, are available.

Flex Up does not create any additional rights beyond those expressly set forth in this Section or as otherwise available under applicable Local Consumer Laws.

6.3 Additional Circumstances Where Flex Up Does Not Apply

Flex Up does not apply if:

  • Your registration is revoked due to rule violations, anti-doping violations, or breach of the Participant Agreement Framework; or
  • Fraud, abuse, or material misrepresentation is detected, as described in Section 6.4 below.
6.4 Fraud or Abuse

The Event Organizer reserves the right, in its reasonable discretion and to the extent permitted by applicable law, to review and verify cancellation requests and to deny payment of the Partial Refund Amount if it reasonably determines that:

  • You provided false, misleading, or fraudulent information in connection with your registration or cancellation request;
  • You participated in the Event (including starting the Event) after submitting a cancellation request;
  • You engaged in fraudulent, abusive, bad-faith conduct, including a pattern of purchasing Event registrations and repeatedly cancelling in a manner that constitutes abuse of Flex Up; or
  • You placed a chargeback with your bank for the purchase of your registration and also submitted a request for a Partial Refund Amount.

The Event Organizer (and/or its service providers) may request additional information reasonably necessary to evaluate a cancellation request. If a request is denied under this Section, no Partial Refund Amount will be payable.

Nothing in this Section limits any other rights or remedies available to the Event Organizer under applicable law.

Article 7 Transfers and Deferrals #

If you transfer or defer your Event registration, or receive any refund, under the Event Organizer's standard policies:

Article 8 EmbedCover and Third-Party Service Providers #

The Event Organizer may use third-party service providers to administer Flex Up, including EmbedCover, which hosts and operates the Partial Refund Request Portal and may process refunds on behalf of the Event Organizer.

You acknowledge and agree that:

To administer Flex Up, the Event Organizer may share certain personal information with EmbedCover so that EmbedCover can authenticate Buyers, review cancellation requests, conduct compliance and fraud screening, process refunds, and otherwise administer Flex Up. The personal information shared may include:

EmbedCover will process this information solely for the purpose of administering Flex Up and in accordance with applicable data protection laws.

These Terms are solely between you and the Event Organizer. No third party (including EmbedCover or any other service provider) is a third-party beneficiary of these Terms.

Article 9 Privacy and Sanctions Screening #

Personal information is processed in accordance with the IRONMAN Privacy Policy available at: https://www.ironman.com/privacy-policy

To comply with applicable financial and sanctions laws (including OFAC and similar international regimes), you will be asked to provide additional identifying information (such as date of birth or place of birth) when submitting a cancellation request.

Failure to provide required information may delay or prevent payment.

Article 10 Modifications to Terms #
10.2 Changes to These Terms

The Event Organizer may modify these Terms to:

  • Comply with applicable laws or regulations;
  • Respond to regulatory guidance or court decisions;
  • Clarify language or correct errors;
  • Improve administrative processes related to Flex Up.
10.3 Which Terms Apply to You

The Terms in effect at the time you purchase Flex Up govern your purchase. Subsequent changes will not affect Flex Up already purchased unless required by applicable law.

10.4 Material Changes

The Event Organizer will not make changes that materially and adversely alter fundamental terms of Flex Up (such as reducing the refund percentage or shortening the cancellation window) without providing notice and, where required by law, obtaining consent.

Article 11 Dispute Resolution and Governing Law #

Flex Up is supplemental to the Participant Agreement Framework.

Any dispute relating to Flex Up shall be resolved pursuant to the Participant Agreement Framework.

Article 12 Statutory Consumer Rights #
12.2 Australia, New Zealand & Malaysia

Nothing in these Terms excludes, restricts, or modifies any rights you may have under the: Australian Consumer Law (ACL) where the Event takes place in Australia; the New Zealand Consumer Guarantees Act (CGA) where the Event takes place in New Zealand; or the Consumer Protection Act where the Event takes place in Malaysia, that cannot lawfully be excluded.

12.3 Canada

Nothing in these Terms excludes, restricts, or modifies any rights you may have under Canadian federal or provincial consumer protection laws that cannot lawfully be excluded. If you reside in Quebec, any mandatory provisions of Quebec consumer protection law apply notwithstanding any contrary provision in these Terms.

12.4 European Union

If you are a consumer residing in the European Union or European Economic Area, you may have statutory rights under applicable consumer protection laws. Flex Up is purchased only together with Event registration and forms part of the overall contract for participation in the Event. Under EU consumer law, a right of withdrawal (cooling-off period) may apply to certain distance/online contracts; however, that right does not apply in some circumstances, including (in particular) where the contract concerns leisure services to be provided on a specific date or within a specific period (such as participation in an Event). If any right of withdrawal nevertheless applies under the laws of your country of residence, you may exercise that right in accordance with those laws. Nothing in these Terms limits any mandatory consumer rights that cannot lawfully be excluded or restricted under the laws of your jurisdiction of residence.

All notices, communications, and correspondence under these Terms shall be delivered to the Buyer at the email address associated with the Buyer's Event registration on file with the Event Organizer at the time of such notice. Notices from the Buyer to the Event Organizer must be sent to flexup@theironmangroup.com or submitted through the Partial Refund Request Portal. It is the Buyer's responsibility to maintain a current and valid email address with the Event Organizer; the Event Organizer shall not be liable for any failure of notice caused by an outdated or invalid email address.

Article 14 General Provisions #
14.2 Entire Agreement

These Terms, together with the Participant Agreement Framework and Privacy Policy, constitute the entire agreement regarding Flex Up.

14.3 Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect, and the invalid provision will be modified to the minimum extent necessary to make it valid and enforceable.

14.4 Waiver

The Event Organizer's failure to enforce any provision of these Terms does not waive its right to enforce that provision or any other provision in the future.

14.5 Assignment

You may not assign or transfer your rights under these Terms or Flex Up. The Event Organizer may assign its rights and obligations under these Terms without restriction.

14.6 Force Majeure

The Event Organizer shall not be liable for any delay or failure to perform its obligations under these Terms due to circumstances beyond its reasonable control, including acts of God, war, terrorism, pandemic, government action, natural disasters, or failures of third-party service providers (including payment processors or banking networks).

14.7 Language

These Terms are provided in English. If translated into other languages, the English version controls in the event of any conflict or inconsistency.

14.8 Headings

Section headings are for convenience only and do not affect interpretation.

14.9 No Third-Party Beneficiaries

These Terms are intended solely for the benefit of the Buyer and the Event Organizer. No third party, including but not limited to EmbedCover or any other service provider, shall have any right to enforce any provision of these Terms or shall be deemed a third-party beneficiary hereof.

14.10 Survival

The following provisions shall survive the termination, expiration, or cancellation of Flex Up and any cancellation of the Buyer's Event registration: Section 6.4 (Fraud or Abuse), Section 9 (Privacy and Sanctions Screening), Section 11 (Dispute Resolution and Governing Law), Section 12 (Statutory Consumer Rights), and Section 14 (General Provisions).
